On August 10, 2009, the New York State Energy Planning Board — under the direction of Governor David Patterson — released a draft of New York State's Energy Plan. The last time such a report was issued was in 2002.

Following the release of the Draft Plan, NYS Energy Planning Board held eight public meetings throughout New York State. Supporters of Indian Point as well as a representative for Entergy (Site VP Joe Pollock) testified supporting the continued operation of the Indian Point units as well as opposing the language in the Draft Energy Plan opposing IPEC relicensing.
